Regulations Governing the Use of Image Materials of the National Museum of Prehistory

1. The Regulations are established to meet the needs of the public to use the image materials of the museum.
2. The image materials referred to in the Regulations include photographs, transparencies, negatives, video files and clips, and digital files.
3. If a digital file exists for the image applied for, as a principle, a digital output or reproduction from the existing digital file shall be provided.
4. The museum does not accept applications for use of image materials that do not belong to the museum.
5. The Regulations shall be applicable to the following persons (herein referred to as "applicants"):
‧Applicants applying for non-profit use of image materials shall complete and turn in an application form. After the application is approved, the museum will charge a material fee in accordance with the regulations of the museum.
‧Applicants applying for for-profit use of image materials shall complete and turn in an application form. After the application is approved, the museum will charge a usage fee in accordance with the regulations of the museum.
6. The application form must include in detail the following items and the sources of image materials, or the application will not be accepted:
(1) Object name, source of image material, type of use, and the number of images.
(2) Purpose of use, language(s) of publication, and release quantity.
7. A credit line must appear adjacent to the image used and should read: Courtesy of the National Museum of Prehistory. Two gratis copies of the published work(s) shall be sent to the museum after publication.
8. The images used shall not exceed one-third of total images from the museum's publications. To avoid the similarities with the research conducted by the museum, when images of the same type of objects are borrowed, the number of objects shall not, as a general rule, exceed half of the objects of this type.
9. When 20 or more images are used for commercial purposes, or when half or more of the images from a single publication are used, applicants are required to, in addition to paying usage fees, negotiate and pay corresponding royalties to the museum, and the royalty rate shall not be less than 8% of retail price.
10. Permission is granted for ONE TIME USE ONLY and is limited to the uses approved in the application. Such permission is non-transferrable. Any other use of the image materials must be applied for separately.
11. Revised editions or subsequent editions require separate application, and a 20% discount on the usage fee will be given.
12. If the applicant does not need the museum to provide image files or materials and can obtain them by the himself or herself, a 20% discount on usage fee will be given.
13. If any of the following conditions occur during the applicant's use of image materials of the museum, the museum may terminate the use at any time. Additionally, no fees paid by the applicant will be refunded, and the applicant will not be allowed to reapply to use the image materials of the museum within two years.
1. Actual use of image materials is inconsistent with the purposes specified in the application.
2. Unauthorized transfer to a third party for use without the approval of the museum.
3. Using image materials without appropriately designating their sources.
4. Engaging in practices likely to damage the rights and benefits of the museum.
14. If any of the conditions described above causes damage to the museum, the museum is entitled to claim compensation from the applicant. The same also applies if causes attributable to the applicant lead to damage to the museum by a third party whether the behavior is intentional or a result of negligence.
15. The museum may claim compensation for the damage from any party using image materials from the museum without authorization or prior consent, or from applicants who charge fees for use of image, copyright fees, or other fees from publishing agencies. In addition, re-application to use image materials of the museum will not be allowed within five years.
16. The Regulations shall take effect after being passed by the museum meeting and approved by the Director. This also applies to revisions.

Points of attention:
  • The image usage fee covers production, usage permission, output, and postage costs.
  • Correct title/object name and number of images needed are required for image usage, and the image material cannot be replaced once borrowed.
  • If a digital file exists for the image applied for, as a principle, a digital output or reproduction from the existing digital file shall be provided.
  • Matters concerning image application, access authority, fee-charging standards and penalties shall be handled in accordance with the Regulations Governing the Use of Image Materials of the National Museum of Prehistory.
  • An applicant who requests an image of particular specifications may negotiate separately and be charged accordingly.
